The City Attorney advices the City Council, the City Manager and all other department heads.DISTINGUISHING FEATURES: This is an at-will position. The City Attorney is appointed by and answer to the City Council.SUPERVISION RECEIVED: The City Attorney is appointed by and reports directly to the City Council.SUPERVISION EXCERCISED: The City Attorney serves as the head of the City's legal department, which consists of a Civil Division and Criminal Division. The City Attorney exercises direct supervision over professional and clerical staff within the legal department.DUTIES AND RESPONSIBILITIES:Essential duties may include any of the following representative duties, knowledge, and skills. The listed duties and responsibilities are not intended to be exhaustive; they are listed only as general illustrations of the various types of work to be performed and of expected responsibilitie.s Specific duties and responsibilities not included are not excluded if they are similar, related, necessary, or logical in relation to the position.Serves as the City's chief legal advisorProvides legal counsel and advice on various municipal areas including public safety, utilities, land use, planning & zoning, building inspection, transportation, human resources, collective bargaining, property managemen,t public meetings, public records, ethics, and other general government issuesAttends various board, commission, and City Council meetings to advice on legal mattersAnswers communications from the public relative to legal matters affecting the CityDrafts and interprets municipal codes and ordinancesAppears on behalf of the City before county, state, and federal courtsWorks with legal specialists engaged by the City for the preparation and trial of complex cases the City may be involved inInvestigates claims by or against the CityPrepares legal opinions, court papers, contracts, ordinances, resolutions, deeds, leases, and other legal documentsAssists in forming proposed legislation for enactment by the state legislature on matters of interest to the CityPrepares reports to City Council regarding pending issues, claims and litigationRepresents the City's interests before individuals, groups, and agenciesPrepares and manages the legal department budgetProvides direct supervision in work activities within the civil and criminal divisionAnalyzes narrative and statistical data to make recommendations regarding legal issues affecting the City Oversees the enforcement of City policies and procedures, and the maintenance of proper recordsSupports the relationship between the City of Nogales and the general publicPerforms other duties as required or assignedKNOWLEDGE OF:City policies and proceduresMunicipal, State and Federal court systemsCriminal Rules of Procedure (State/Federal)Civil Rules of Procedure (State/Federal)SKILL IN:Using initiative, discretion and judgment within established procedures guidelines and rulesDefining problems; establishing facts and drawing valid conclusionsManaging situations requiring diplomacy, fairness, firmness and sound judgmentMulti-taskingEstablishing and maintaining cooperative working relationships with managers , supervisors, employees, external public and private agencies, crime victims and the general publicCommunicating effectively, both verbally and in writingOperating a personal computer and various software applications
